These terms and conditions apply to the website https://psypack.com.

By accessing this Site, you agree to comply with and to be bound by all these terms and conditions. Do not sign up or subscribe if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions:

"Client" means any user who has signed up on the Site to availing advice from Practitioners subscribed to the Site.

"Practitioners" includes coaches, therapists, psychologists, social workers, counsellors and other behavioural healthcare professionals, who are subscribed to using the Site for their professional work.

"Service" means any or all of the services offered on https://psypack.com.

"Site" means https://psypack.com, including all URLs within said domain and sub-domains.

“The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to XequalsZero Pvt. Ltd., having regd. office at 289, Model Gram, Ludhiana, PB 141002, IN and CIN: U72900PB2018PTC048066.

“You” and “Your” refers to you, the person logging on to this website. This could be a Practitioner, a client or other visitors.

Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable, and, therefore, as referring to the same.

CONTENT

The Site is a web application that can be used by Practitioners for streamlining their workflow, including having access to psychometric assessments, administering psychometric assessments to clients, scoring psychometric assessments, preparing reports, making notes, keeping in contact with their clients and viewing and managing information about their clients/patients in relation to their treatment and personal growth. Clients can use the app to appear in the psychometric assessments and engage in activities that are assigned by the practitioner and keep their personal information up to date.

WHAT WE DO NOT DO

WE ARE NOT OFFERING OR ATTEMPTING TO OFFER MEDICAL ADVICE.

CLIENT RELATIONSHIP WITH THE PRACTITIONER IS STRICTLY WITH THE PRACTITIONER. PSYPACK IS NOT INVOLVED IN THE PRACTITIONER-CLIENT RELATIONSHIP AND DOES NOT INTERFERE, INFLUENCE, VALIDATE OR CONTROL, WHETHER DIRECTLY OR INDIRECTLY, THE PRACTITIONER’S ADVICE OR TREATMENT.

ACCOUNT SIGN UP

To access the Services, you must first sign up or subscribe, as applicable, to establish an individual user account (“Account”), by providing certain information. You agree that you will not create more than one Account or create an Account for anyone other than yourself without first receiving permission from the other person. YOU SHALL AT ALL TIMES REMAIN RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR ACCOUNT PASSWORD AND USERNAME (IF ANY) AND ANY OTHER SECURITY INFORMATION RELATED TO YOUR ACCOUNT. WE WILL NOT BE LIABLE FOR ANY LOSS THAT YOU INCUR AS A RESULT OF SOMEONE ELSE ACCESSING AND USING YOUR ACCOUNT, EITHER WITH OR WITHOUT YOUR KNOWLEDGE.

ACCEPTABLE USE

When using the Services, you agree that you will:

Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
Provide accurate information to us and keep it updated;
Comply with any instructions and technical specifications provided by PsyPack, to enable the proper functionality of the Services, including by not altering or modifying any computer code provided to you;
Communicate your requests, queries and other submissions with respect to your use of the Services, only to PsyPack; and
Use the Services responsibly.

When using the Services, you agree that you will not:

Create a false identity on PsyPack, misrepresent your identity, create a user profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
Develop, support or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plugins and add-ons, or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
Override any security feature or bypass or circumvent any access controls or use limits of the Service;
Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties, without the consent of PsyPack;
Disclose information that you do not have the consent to disclose (such as confidential information of your patients).
Violate any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

PAYMENT

You authorize us to charge your chosen payment method for any paid services. By providing a payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your purchase (including any applicable taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your Paid Service may be suspended or cancelled. You must resolve any problem we encounter in relation to the payment method you select to proceed with your use of the Service.

INTELLECTUAL PROPERTY

The Company is the owner of all rights over PsyPack™ as well the website, including its design. You must not copy, republish, reproduce, duplicate, copy, sell, rent, license, or sub-license the same.

Some of the psychometric assessments are from the public domain without restriction on reproduction or use, whereas the intellectual property over others may be owned by third parties and PsyPack has been licensed to use, publish, or reproduce the same. In all cases, we have complied with the required attribution obligations, apart from identifying the source. You may republish, redistribute, reproduce, duplicate, copy, sell, rent, license or sub-license the respective psychometric assessment only in accordance with the terms as mentioned in the source of the psychometric assessments.

All other contents of the Site are the sole and exclusive intellectual property of the Company. You must not copy, republish, redistribute, reproduce, duplicate, sell, rent, license or sub-license any such material from the Site.

All others intellectual property rights are reserved.

HYPERLINKS

Any link (including a hyperlink, button or referral device of any kind) used in the Service is provided for your use and convenience. The appearance of a link does not constitute an endorsement, recommendation or certification by PsyPack, nor should the presence of a link in any way be construed as a suggestion that any third party website has any relationship to PsyPack. PsyPack is not responsible for the content of linked third-party websites or third-party advertisements, and does not make any representations regarding its content or accuracy. PsyPack does not knowingly link to websites that may infringe on valid and existing trademarks, service marks, copyrights, or patents. YOUR USE OF THIRD-PARTY WEBSITES IS AT YOUR OWN RISK AND SUBJECT TO THE TERMS AND CONDITIONS OF USE FOR SUCH WEBSITES.

We do not offer any refunds. But we do offer a free trial to enable you to make an informed choice. So, make the right one!

INDEMNIFICATION

To the extent permitted by law, you agree to hold harmless, indemnify and defend us, our directors, shareholders and affiliates, from and against any and all claims, charges, demands, damages, liabilities, losses, expenses, and liabilities of whatever nature and howsoever arising (including but not limited to any legal or other Practitioner fees and the costs of defending or prosecuting any claim and any loss of profit, goodwill, and any other direct or consequential loss) incurred or suffered directly or indirectly by reason of any act or omission that you commit in breach of these terms and conditions, or for violation of applicable law.

DISPUTE RESOLUTION

We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply.

FOR ANY CLAIM, CAUSE OF ACTION, OR DISPUTE YOU HAVE AGAINST US THAT ARISES OUT OF OR RELATES TO THESE TERMS OR THE SERVICES ("CLAIM"), YOU AGREE THAT IT WILL BE RESOLVED EXCLUSIVELY IN THE COURTS IN THE UNION TERRITORY OF CHANDIGARH, INDIA. You also agree to submit to the personal jurisdiction of these courts for the purpose of litigating any such claim, and that the laws of the INDIA will govern these Terms and any claim, without regard to conflict of law provisions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXCLUDE ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS RELATING TO OUR WEBSITE AND THE USE OF THIS WEBSITE.

HAVING CERTAIN PSYCHOMETRIC ASSESSMENTS ON THE SITE COM DOES NOT MEAN AUTHORS/OWNERS ENDORSE PsyPack.

THIS ABOVE IS WITHOUT PREJUDICE TO THE DISCLAIMERS SPECIFICALLY IDENTIFIED IN OTHER PARTS OF THE SITE, INCLUDING IN EACH PSYCHOMETRIC ASSESSMENT.

TERMINATION

We may suspend or terminate your access to the Service at any time, for any reason or for no reason at all. PsyPack has the right (but not the obligation) to refuse to provide access to the Service to any person, agency, or organization at any time, for any reason or for no reason at all, in our sole discretion. We reserve the right to change, suspend, or discontinue all or part of the Service, temporarily or permanently, without prior notice.

MODIFICATIONS OF TERMS AND CONDITIONS

If any provision of these terms and conditions is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions

We reserve the right to amend the pricing of the Services and these terms and conditions at any time without prior written notice.
