A. Are you required to submit personal information?

Yes, you are required to provide some personal information in order for us to enable your access to our Services. This is indicated when you sign up for an account and you give explicit consent. The payment information is required to be able to process your payment when you purchase a subscription to the software and your basic contact details and financial information are required for us to comply with legal obligations.

Please do note that if you are only visiting or browsing the Site without signing up or subscribing to an Account, we do not collect any personal information except as covered by our Cookie Policy .

WE DO NOT PROCESS ANY HEALTH-RELATED INFORMATION OTHER THAN THE PSYCHOMETRIC ASSESSMENTS ANSWERED BY CLIENTS. WE ALSO DO NOT HAVE ACCESS TO, OR RECORD OR OTHERWISE PROCESS, ANY PRACTITIONER-CLIENT COMMUNICATIONS, EXCEPT FOR METADATA LIKE TIME-STAMPS, COORDINATES, IP ADDRESS.

D. How do we collect your personal information?

We only collect your personal information from you, when you sign up or subscribe to an account on the Site. The only exception is the payment method (e.g. "Credit Card") and reference (e.g. last four digits of the Credit Card) from our third-party payment processor solely to display in customer information page and/or for billing purposes.

E.For what purposes do we use your personal information?

We use your personal information for the following purposes:

If you agree to this Privacy Policy, your personal information will be shared with your Practitioner to enable your Practitioner to render services to you through the Site. The Practitioner, under applicable professional and legal norms, are bound not to disclose your personal information.

If you agree to our Cookie Policy and this Privacy Policy, the following personal information will be shared with Google, Facebook, Twitter, LinkedIn, for the following purposes:

  • Provenance and IP Address, to serve interest-based advertisements and to aggregate data about site traffic, site interaction and preferences

We make use of service providers, such as

  • the hosting provider of our website (Google),
  • advertising service providers, a payment service provider (Google, LinkedIn, Twitter, Facebook),
  • an administrative service provider,
  • an IT-development company,
  • an email marketing provider,
  • an analytical service provider, and
  • an IT-support company,

to be able to offer and operate our websites, and our business. We may be required either by law or for practical reasons, disclose certain personal information to such third parties, we will then endeavor to only disclose personal information that is strictly required.

F. WHERE DO WE STORE YOUR PERSONAL INFORMATION?

We store your personal information in the Google Cloud Server with certified privacy security and certified to be GDPR compliant. Please refer to their GDPR Resource Centre here.

G. How long is your personal information stored?

We store your personal information as long as you have an account with us. When you close your account, your personal information will be deleted after three months. When you end your subscription or fail to meet your payment obligation your personal information will be stored for three months and will then be permanently deleted.

Please not, however, that may be exceptions to this under applicable laws. That may be information we are required to store pursuant to tax laws in various countries, such as information relating to your subscription and transactions and our financial obligations, for a period of seven years. Similarly, we may have to retain your personal information in relation to a dispute with you, if applicable, whether with us or a third party. in which case we will save it until it is no longer required for the dispute. Similarly, we may retain your information if directed by applicable law or by order from a Court, judicial authority or other authority acting under applicable law.

H. DO WE SELL YOUR PERSONAL INFORMATION?

NO. WE DO NOT SELL OR TRADE YOUR PERSONAL INFORMATION. WE ALSO DO NOT OFFER A FINANCIAL INCENTIVE FOR YOUR SUBMISSION OF YOUR PERSONAL INFORMATION.

I. PAYMENT INFORMATION

Since payments are processed by a third-party payment processor, we do not store payment information. Note that third-party payment processors may retain this information in accordance with their own privacy policies.

Since we are a customer to said payment processor, your payment information may be accessible to us from the servers of said payment processor. However, we do not process such payment information accessible from the payment processor, except for the payment method (e.g., "Credit Card") and reference (e.g., last four digits of the Credit Card) solely to display in the customer information page and/or for billing purposes with you.

Our Site is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

  • under certain conditions to object to the processing of your personal information;
  • when we use your personal information for direct marketing purposes, you can object to this unconditionally;
  • if you have given consent for the processing of your personal information, to revoke that consent (this applies to future use of your personal information);

L. Health Insurance Portability and Accountability Act ("HIPAA") and CALIFORNIA CONSUMER PRIVACY ACT (CCPA) RELATED clarifications

We are not a covered entity under the HIPAA. However, since we receive, create or use psychometric assessments, which may be construed as individually identifiable health information for or on behalf of a covered entity, we have a HIPAA compliant Business Associate Agreement with the Practitioners subscribed to our Services.

PsyPack recognizes that California has articulated specific privacy rights. California Users should understand that We do not sell user data to third parties, however, we do make available certain information available to specific third parties as already listed in section E above.

We also do not discriminate between visitors or users.
